TERMS OF SERVICE (AGB)

1. GENERAL & SCOPE
This website is operated by Real Steel Bikes (Michael Krause). Throughout the site, the terms “we”, “us”, and “our” refer to Real Steel Bikes. By visiting our site and/or purchasing from us, you agree to be bound by the following Terms of Service. These terms apply to all visitors, customers, and merchants.

2. CONCLUSION OF CONTRACT
The presentation of bicycles, frames, and components in the online shop does not constitute a legally binding offer, but an invitation to place an order. By completing the checkout process and clicking the final purchase button, you submit a binding offer to purchase the selected items. 
The contract becomes legally effective once we send you an order confirmation via email or dispatch the ordered goods.


3. PRICES, TAXES & SHIPPING
• All prices shown are final prices in Euro (€). Due to the small business status pursuant to § 19 UStG (German Value Added Tax Act), value-added tax is not charged or displayed on invoices.
• Shipping costs are calculated and displayed clearly before checkout:
  - Germany: Free shipping
  - European Union (EU): €80.00
  - Worldwide: €200.00
• For deliveries outside the European Union, import duties, customs taxes, and administrative fees may apply depending on the destination country. These costs are the sole responsibility of the customer.


4. SHIPPING, PACKAGING & FINAL ASSEMBLY
All bicycles are thoroughly inspected, packed with specialized protective materials, and shipped in reinforced bike boxes with door-to-door insurance and tracking.
To ensure maximum transit protection:
• Bicycles arrive partially disassembled (wheels detached via quick-release, handlebars turned, pedals detached).
• Final reassembly requires only basic tools (standard hex/Allen keys and a 15 mm pedal wrench). 
• It is the buyer's responsibility to ensure all screws and quick-releases are properly tightened before the first ride.


5. STATUTORY WARRANTY & 12-MONTH STORE WARRANTY
• Statutory warranty rights under German law apply to all items.
• In addition, Real Steel Bikes grants a voluntary 12-month store warranty on fully restored and overhauled bicycles, covering frame integrity and technical roadworthiness under normal riding conditions.
• The warranty does not cover regular wear and tear (such as tires, brake pads, chains, cables, and bartape), damage resulting from improper use, crashes, overloading, or incorrect reassembly by the customer.


6. RIGHT OF WITHDRAWAL (CANCELLATION)
Consumers residing in the European Union are entitled to the statutory 14-day right of withdrawal. The full terms, procedure, and model withdrawal form are available under our separate Return & Cancellation Policy page.


7. LIMITATION OF LIABILITY
• We are liable without limitation for intent, gross negligence, and for damages resulting from injury to life, body, or health.
• In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations – duties essential for the proper execution of the contract). In such cases, liability is limited to foreseeable, contract-typical damage.
• Any further liability, regardless of legal basis, is excluded. Mandatory statutory liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.


8. ONLINE DISPUTE RESOLUTION
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


9. GOVERNING LAW & SEVERABILITY
• These Terms of Service and all purchase contracts shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers residing within the EU, mandatory statutory consumer protection laws of their country of residence remain unaffected.
• Should any individual provision of these Terms be or become invalid, the validity of the remaining provisions shall remain fully unaffected.
